TERMS AND CONDITIONS
1. Acceptance
1.1 You accept this agreement when you:
- Follow instructions on the provided quotation to confirm acceptance.
- Email a signed copy to wingwattsolar@gmail.com.
1.2 Acceptance is considered effective on the date Solar Era receives the signed and completed document. If received after business hours, acceptance is deemed on the next working day.
1.3 Final safety inspections and meter-related processes will begin only after the payment mentioned in your quotation is received.
1.4 If the installation site requires work beyond standard procedures, additional charges may apply.
1.5 Solar Era reserves the right to cancel this agreement without obligation or penalty within 7 days of acceptance.
1.6 Solar buy-back rates (feed-in tariffs) are set quarterly by SP Group under EMA regulation. Solar Era is not liable for any changes to such laws or tariffs that affect the expected return on investment.
1.7 Solar system performance may vary due to environmental conditions and shading. Any power generation estimates provided are only indicative.
1.8 Solar Era may cancel this agreement without penalty if, at its discretion, installation is deemed unfeasible due to safety, access, structural concerns, shading, or material availability. In such cases, your deposit will be refunded in full.
1.9 Any misleading or incorrect information provided by you that results in damage or losses.
2. Nature of the Agreement
2.1 This document forms a contract for the purchase and installation of a solar energy system at the specified site.
2.2 The contract becomes effective upon your acceptance of the quotation.
3. Definitions
This section outlines key terms used throughout the agreement, such as “Agreement,” “Customer,” “Completion,” “Installation,” “Quotation,” “Purchase Price,” and other relevant definitions related to Solar Era’s operations and the regulatory context in Singapore.
4. Products and Services
4.1 You agree to purchase the specified solar system and related services for your premises as per the quotation and this agreement.
4.2 Solar Era commits to installing the system to professional standards upon acceptance.
5. Customer Responsibilities
5.1 You acknowledge that the system will meet its intended use under the manufacturer’s specifications and Singapore’s Consumer Protection standards.
5.2 Intellectual property related to the system and installation belongs to Solar Era or its suppliers.
5.3 These terms apply to all orders placed by you.
5.4 Solar Era will bear the cost of external metering and monitoring equipment installation unless stated otherwise in the quotation.
5.5 You understand that performance may vary with environmental conditions and that energy output figures are estimates.
6. Payments
6.1 A down payment is due upon acceptance.
6.2 This deposit is non-refundable if you cancel due to a default on your part.
6.3 Final inspection and meter setup only proceed once full payment, as quoted, is made.
6.4 If any information you provided is significantly inaccurate and results in a cost increase above 5% of the quoted price, a revised agreement must be discussed and agreed upon before continuing.
6.5 Solar Era is not responsible for third-party fees not outlined in the agreement.
7. Site Inspections
7.1 You confirm your property is fit for system installation.
7.2 Solar Era may access the property for inspection, and you agree to be present or send a representative when required.
8. Installation Permissions
8.1 You authorise Solar Era to:
- Carry out installation.
- Apply for a grid connection.
8.2 You confirm ownership of the property and that you grant necessary access to complete the work.
8.3 You agree to sign the required documents to support installation and grid connection.
8.4 Both parties agree to handle all required permits or approvals.
8.5 You must ensure access to utilities like electricity and water during installation.
9. Delivery and Installation
9.1 Solar Era will coordinate the system’s delivery and installation based on the agreed timeline.
9.2 Installations may be delayed due to:
- Stock shortages
- Weather
- On-site complications
- Other unforeseen issues
9.3 Notice of any date change will be provided.
9.4 If your electrical switchboard needs upgrades, you are responsible for the cost.
9.5 Unreported access challenges may incur extra costs.
9.6 Meter replacement fees are covered by Solar Era, if required.
10. Ownership and Risk
10.1 Ownership transfers to you after:
- Full payment is made.
- Any required documents are signed.
10.2 Risk passes to you once the system is installed.
11. Property Access
11.1 You grant Solar Era access to your premises for all necessary work.
11.2 A $200 fee applies if installation cannot proceed due to your absence, except in exceptional cases.
11.3 If you do not own the property, you must have the owner’s permission for the installation.
11.4 You are still liable for the purchase, even if not the property owner, and will cover any resulting losses due to unauthorised work.
12. Cancellation
12.1 Solar Era may cancel the agreement if you fail to meet its terms.
12.2 If you sell your property before installation, the agreement may be voided.
12.3 If cancellation happens before installation:
- You must cover costs already incurred (e.g. deposits, inspections, restocking).
12.4 If cancellation occurs after installation and payment has not been made:
- Solar Era may reclaim the system and sell it to recover outstanding payments.
12.5 If the property is sold after installation and payment is still due, the debt remains secured against your assets.
12.6 Solar Era can reclaim the system if full payment is not received.
12.7 If cancellation is due to your breach, you will bear removal and recovery costs.
12.8 If you cancel before the system is ordered, your deposit and any advance payments are non-refundable.
13. Non-Payment
13.1 Interest of 15% per annum (calculated daily) applies to overdue payments.
13.2 You are responsible for all debt recovery costs.
14. Installation Warranty
14.1 Solar Era guarantees the installation complies with all relevant local codes and standards.
14.2 A 24-month workmanship warranty begins from the installation completion date.
14.3 Property damage during installation will be repaired if reported within 3 months, except when caused by pre-existing issues.
14.4 The warranty does not cover damage caused by:
- Natural disasters or electrical surges
- Water damage
- Poor maintenance
- Unauthorised changes
- Improper equipment use
- Force majeure
14.5 Solar Era is not liable for any issues with existing home infrastructure.
14.6 Manufacturer warranties apply to all products used; copies available upon request.
14.7 Consumer rights under Singapore law remain unaffected.
15. Product Warranty
15.1 Warranty updates will be posted on Solar Era’s website as notified by product manufacturers.
15.2 Faulty components will be reviewed and, if valid, replaced or repaired under warranty.
15.3 Equivalent components may be substituted if original parts are unavailable, provided performance is not compromised.
16. System Performance Disclaimer
16.1 Output depends on factors like sunlight hours, cloud cover, and surrounding shade.
16.2 Solar Era will aim to optimise placement for maximum output.
16.3 No guaranteed performance is provided beyond what’s in your quotation or manufacturer warranties.
17. Limitations of Liability
17.1 Only warranties stated in this agreement or required by law are applicable.
17.2 Where permitted, Solar Era’s responsibility is limited to repair or replacement.
17.3 Solar Era is not liable for additional damages or losses outside these terms.
17.4 This agreement contains all terms between both parties.
17.5 You agree to hold Solar Era and its representatives harmless against third-party claims related to this contract.
18. Force Majeure
18.1 Events outside of Solar Era’s control (natural disasters, supply chain issues, legal restrictions, etc.) may result in adjusted timelines or contract cancellation without penalty.
19. Privacy
19.1 Personal data collected will comply with the Singapore Personal Data Protection Act (PDPA).
19.2 Your information may be shared to facilitate system registration and connection.
19.3 It may be disclosed to:
- Authorities
- Partners and contractors
- Other parties as legally required
19.4 You consent to the use of your data by accepting this agreement.
19.5 To review or update your data, contact Solar Era directly. The full privacy policy is available on request.
20. General Provisions
20.1 This document is the entire agreement.
20.2 Singapore law governs this agreement.
20.3 References to Solar Era include staff, contractors, and representatives as necessary.
20.4 Clause headings are for reference and do not affect interpretation.
